Contract
Terms of service
§ 1 Scope and contracting party — These Terms govern the use of Renzom game server hosting (the “Services”) offered by 09Clicks c/o GAM, Pappelallee 64, 10437 Berlin, Germany (“Renzom”, “we”) — kontakt@09clicks.de. Consumer means any natural person entering into the contract for purposes outside their trade or profession.
§ 2 Service description — We provide virtualised game server resources (e.g. RAM, CPU, storage, network) via our infrastructure and, where applicable, the Pterodactyl-based game panel. The exact scope follows the plan you select at checkout (game, RAM, slots, loader where shown). We aim for high availability but do not guarantee uninterrupted operation.
§ 3 Conclusion of contract — The presentation on the website is an invitation to order. The contract is formed when you complete checkout successfully and we accept the order (e.g. confirmation email and/or appearance of the service in your customer panel).
§ 4 Prices and payment — Prices are shown in euros including applicable VAT where stated. Payment is processed via Stripe (cards and methods offered there). Recurring fees are charged according to the billing interval you choose until cancelled in line with Stripe and these Terms.
§ 5 Term and cancellation — Subscriptions renew automatically for the chosen term until you cancel through the Stripe customer portal or another cancellation method we communicate. Statutory rights of consumers (including withdrawal where applicable) remain unaffected.
§ 6 Fair use and resource limits — Plans define RAM, slots, and CPU/disk limits. Features labelled “unlimited” are subject to fair use: excessive load, mining, proxies unrelated to gaming, or behaviour that degrades other customers may lead to throttling or suspension after notice where reasonable.
§ 7 Your obligations — You must provide accurate account data, keep credentials confidential, comply with applicable law, game publishers’ licences (e.g. Minecraft EULA), and our acceptable-use rules. You are responsible for backups of worlds and data you care about; we may offer backups only if explicitly included in your plan.
§ 8 Suspension for payment default — If Stripe reports a failed or overdue payment, we may suspend the game server (no runtime) until payment succeeds. Long-term default may lead to termination and deletion after prior notice where required by law.
§ 9 Liability — We are liable without limitation for intent and gross negligence and for injury to life, body, or health. For slight negligence we are liable only for breach of essential contractual obligations, limited to foreseeable typical damage. Liability for indirect or consequential loss applies only as mandatory law requires.
§ 10 Changes — We may update these Terms for good cause (law, product, security). We will notify you of material changes by email or notice in the panel. Continued use after the effective date may constitute acceptance where permitted by law.
§ 11 Governing law and venue — For consumers resident in the EU, mandatory consumer protection laws of your country of residence apply where they offer stronger protection. Otherwise German law applies. Venue for merchants is Berlin; for consumers, statutory venues apply.
